TREMAINE v. STATE

No. 95-02791.

698 So.2d 1385 (1997)

Troy TREMAINE, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

September 19, 1997.

Attorney(s) appearing for the Case

James Marion Moorman, Public Defender and Megan Olson, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Deborah F. Hogge, Assistant Attorney General, Tampa, for Appellee.

FRANK, Judge.

Troy Tremaine appeals from his judgment and sentence for aggravated battery. We affirm the judgment and sentence, but strike certain portions of the sentence and conditions of probation.

Tremaine correctly argues that the trial court erred when it ordered his sentence for aggravated battery to run consecutive to any sentence to be imposed in a case pending in Ohio. See Pattmon v. State, 404 So.2d 1177
