Defendant, Wayne Amato, was charged by grand jury indictment with public pay roll fraud, filing false public records, theft of an amount greater than $100.00 but less than $500.00, and unauthorized use of movables, violations of La. R.S. 14:138, 14:133, 14:67 and 14:68, respectively. He pled not guilty and was tried by jury. Upon motion of defendant, his first trial ended in a mistrial.
