Health Cost Controls ("HCC") sued Karen Bichanich ("Bichanich") under ERISA to recover medical benefits paid to her through her employer-sponsored health care plan. Both parties filed motions pursuant to Fed. R.Civ.P. ("Rule") 56(c) for summary judgment.
