Defendant David Weinstein appeals from a judgment entered in the Superior Court (York County, Crowley, J.) awarding plaintiff Goldberg Realty Group (GRG) a commission pursuant to the terms of a real estate listing contract. Weinstein argues on appeal that the court erred in ruling that GRG's failure to disclose certain facts relating to the sale did not constitute a breach of fiduciary duty.
