In her first assignment of error, the defendant says the court should not have submitted to the jury the charge of first-degree murder based on premeditation and deliberation. She bases this argument on the action of the district attorney who announced at the pretrial conference that the State would not try the defendant for murder based on premeditation and deliberation, but would try her solely for felony murder.
