Underlying this dispute is the landlord's application for increases to the Maximum Base Rent (MBR) for the 1986/87 and 1988/89 cycles for its rent controlled apartments at 251 West 92nd Street. The District Rent Administrator granted the increases. In applying for these increases, the landlord certified that it had removed all of the rent impairing code violations and at least 80% of the non-rent impairing violations.
