Defendant York Hospital has moved for summary judgment in the above captioned action pursuant to Pennsylvania Rule of Civil Procedure 1035. This court has reviewed the parties' submissions and pleadings.1 For the reasons set forth herein, we grant the defendant's motion for summary judgment, in part, and deny the defendant's motion for summary judgment, in part.
