Before the court are the plaintiff's motion for summary judgment and the defendant's cross-motion for summary judgment. The plaintiff brought this action to recover damages arising from an automobile accident which occurred when she was a passenger in the defendant's automobile. The parties briefed their respective positions and oral argument has been heard.
