Order unanimously reversed without costs and motion to vacate judgment and warrant denied.

The underlying nonpayment proceeding was commenced against the tenant respondent seeking the amount of $1,317.53. Said amount reflected rent payments ($407.51 per month) due for the months of May, June, and July 1994, plus $95 in legal fees.
