This matter comes before the Court upon Petitioner's Motion for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2255. Mark D. Waldemer was convicted after trial on one count (Count 12) of making a false statement. United States v. Waldemer, Case No. 92-30111.
