The defendant, Woodrow Clifford Curtis, appeals from a trial court ruling granting summary judgment in favor of the plaintiff, Rita Gay Ferrell Curtis. The trial court found that, during negotiations for a community property partition agreement, the defendant withheld information from the plaintiff regarding farming partnership profits received in 1994, after their physical separation and prior to their divorce judgment.
