James Ross filed suit against NOPSI, NORCO, and the City of New Orleans for injuries he sustained on April 4, 1992, when his bicycle struck a depression on Dauphine Street. NOPSI and NORCO filed a motion for summary judgment contending that there were no genuine issues of material fact and that they were entitled to judgment as a matter of law because they were not responsible for correcting the depression into which Mr. Ross fell.
