Charles Moore ("Moore") was injured on the premises of Shell Oil Company. Moore's direct employer, Jacobs Constructors, Inc. ("Jacobs"), immune from liability under the provisions of the Workers' Compensation Act,1 was not a party to the subsequent lawsuit. After a trial by jury, the jury assessed fault against Jacobs in accordance with then-existing Louisiana jurisprudence. The jury found Moore, Jacobs, Shell Oil Company...
