This case presents familiar problems of federal jurisdiction, civil procedure, and the relationship between court and agency; but the problems arise in an unusual context: that of the unique and complex legal regime that governs trademarks and unfair competition. Since the appeal is from an order granting a motion to dismiss, we draw our facts from the pleadings.
