PEOPLE v. CLARK

Docket No. 103664, Calendar No. 9.

556 N.W.2d 820 (1996)

453 Mich. 572

PEOPLE of the State of Michigan, Plaintiff-Appellant, v. Bertha CLARK, Defendant-Appellee.

Supreme Court of Michigan.

Decided December 27, 1996.

Attorney(s) appearing for the Case

Frank J. Kelley, Attorney General, Thomas L. Casey, Solicitor General, Tony Tague, Prosecuting Attorney, and Kevin A. Lynch, Senior Assistant Prosecuting Attorney, Muskegon, for people.

State Appellate Defender by Fred E. Bell, Lansing, for defendant-appellee.

OPINION

MALLETT, Justice.

The defendant was convicted by a jury of involuntary manslaughter in the death of her four-year-old son and was sentenced to a prison term of seven to fifteen years. The Court of Appeals reversed, holding that the defendant was prejudiced by a change in the jury instructions. We would affirm the decision of the Court of Appeals that the defendant was prejudiced by the change in the instructions and is entitled to a new trial.
