The defendant, Salvador Ribas Dominicci ("Ribas"), has been indicted on five counts of stealing, converting and selling government property in violation of 18 U.S.C. § 641. He now moves this Court to strike an insufficient allegation and prejudicial surplusage, and to dismiss the indictment because it fails to charge an offense.
