STATE v. BIBLE

No. 33297-0-I.

77 Wn. App. 470 (1995)

892 P.2d 116

THE STATE OF WASHINGTON, Respondent, v. LOPEZ BIBLE, Appellant.

The Court of Appeals of Washington, Division One.

April 10, 1995.

Attorney(s) appearing for the Case

Suzanne Lee Elliott of Washington Appellate Defender Association, for appellant.

Norm Maleng, Prosecuting Attorney, and Amy Jean Freedheim, Deputy, for respondent.

BAKER, A.C.J.

Lopez Bible appeals the trial court's dismissal of his prosecution without prejudice. He argues that the charges against him should have been dismissed with prejudice because the State sought the dismissal to avoid the speedy trial rule and had mismanaged the case. We affirm, because the trial court justifiably based its ruling upon unavailability of necessary witnesses for the prosecution.
