Damian Monserrat, this defendant, was tried at a bench trial before this court, and at the conclusion of that trial, he was found guilty of murder of the third degree and aggravated assault. These convictions were rooted in a criminal episode in which this defendant fatally battered Rosaline Roman, a three-month-old baby, while in the process of simultaneously assaulting Damarys Torres, his girlfriend.
