Appellant Kenneth Arenson prevailed in his race discrimination claims before a jury and on appeal to this court, which reversed the district court's grant of judgment against him as a matter of law. Although this court simply reversed the trial court's judgment, the district court ordered a new trial. Arenson lost the second trial. The principal question now is whether the district court could grant a new trial following the first appeal...
