OPINION

STRUBHAR, Judge:

Appellant, Sidney Soren Scott, was tried by jury in the District Court of McIntosh County, Case No. F-90-34, before the Honorable J.M. LeMasters, Jr., Associate District Judge. Appellant was convicted of Murder in the First Degree (21 O.S.Supp. 1989, § 701.7(A)). The jury found two (2) aggravating circumstances and recommended the death penalty.
