OPINION

VANCE, Justice.

Robert Teer was convicted of the aggravated kidnapping of Christina Teer, his estranged wife, from a Waco billiard hall. See Tex.Penal Code Ann. § 20.04(a) (Vernon 1994). A jury found him guilty and, because it also found that he did not voluntarily release Christina in a safe place, assessed his punishment for the first-degree felony at forty years in prison. See id.
