RICHARDS, Justice.

This is an appeal from a summary judgment entered in favor of appellee, Jackie Newton, in a suit brought by his former wife, appellant Rosalie Newton.

Two issues are presented on appeal: (1) whether the district court erred in granting summary judgment; and (2) whether the presiding judge of the court in which the suit was originally filed—the County Court at Law Number One of Grayson County— abused his discretion...
