On January 23, 1992, following a bench trial in the District Court of the First Circuit, the petitioner-appellant John G. Pone was convicted of criminal property damage in the fourth degree, a petty misdemeanor, in violation of Hawai`i Revised Statutes (HRS) § 708-823 (1985), for having intentionally damaged the front door of the complainant's apartment without his consent. Pone was sentenced to a fine of $25.00 and ordered to assume the cost...
