Defendant, Michael Pertee II, has filed a motion to dismiss. The state alleges that defendant drove while under a drug-paraphernalia suspension. Driving under such a suspension violates R.C. 4507.02(D)(1).

Defendant contends that there is no rational relationship between possession of drug paraphernalia and operating a motor vehicle. Consequently, he argues that such a suspension is an unconstitutional exercise of the state's police...
