Defendant-appellant James D. Clemmons was an insurance salesman who in 1988 acquired a list of names of persons who were either retired or close to retirement. He mailed these individuals business reply cards offering to check the individual's future Social Security benefits at no cost to them. Clemmons or one of his employees would meet with those who responded to this mailing and offer a better return on their savings than they were currently...
