This matter is before the Court on a motion by defendant Securities Investor Protection Corporation (SIPC) to dismiss plaintiff's complaint for lack of subject matter jurisdiction, to transfer the matter to the bankruptcy court, or to dismiss for failure to state a claim upon which relief may be granted.
