HANSEN, Circuit Judge.

In this diversity case, Charles R. Tart appeals the district court's1 judgment dismissing his Missouri Human Rights Act claim of discriminatory discharge following a jury verdict in favor of Hill Behan Lumber Company (Hill Behan). Tart contends that the district court erred by refusing to instruct the jury on racial harassment in the workplace or on his theory of agency. We affirm.
