Appellants challenge the constitutionality of R.C. 2744.02(B)(4)1 under the due process and equal protection provisions of the Ohio and United States Constitutions, and the right to remedy provision of the Ohio Constitution. We conclude that the statute is constitutional and affirm the court of appeals.
