Defendant appeals his conviction for the third degree felony of distributing a controlled substance in violation of Utah Code Ann. § 58-37-8(1)(a)(ii) (1994). Defendant raises two issues on appeal: (1) whether the trial court erred by permitting into evidence defendant's prior misdemeanor conviction of attempted distribution of a controlled substance; and (2) whether the trial court erred in refusing to give the jury defendant's proposed jury instructions...
