Defendant, William Rodney Brossette, was charged by grand jury indictment with one count of aggravated rape, in violation of La. R.S. 14:42. During trial by jury, which began on October 16, 1992, Brossette moved for a mistrial based on alleged improper questioning of a defense expert by the prosecutor. The court denied this motion. After retiring to deliberate on October 23, 1992, the jury returned twice and informed the court that they were deadlocked...
