DUGGAN, Justice.

This is an appeal from a take-nothing summary judgment in favor of appellee, E.I.L. Instruments, Inc. (EIL). We affirm.

EIL was an employer enrolled under the Emergency Veteran's Job Training Act of 1983. 29 U.S.C. § 1721 note (1988) (the Act).
