OPINION

DORSEY, Justice.

Appellant, Jose Serna, Jr., appeals his conviction for aggravated assault. He raises four points of error. We affirm.

In his first point of error, appellant contends that the trial court erred in failing to dismiss this prosecution because of double jeopardy. Appellant filed a motion to dismiss in advance of trial, asserting that he had previously been placed in jeopardy for the same offense, and thus could not be retried...
