STATEMENT OF THE CASE

Jack J. Stallsworth appeals from the trial court's order granting summary judgment in favor of Anselmo Munoz and Fidel & Sons Swimming Pools, Inc. (collectively "Munoz"). As a result of an automobile accident with Munoz, Stallsworth sustained bodily injuries. Stallsworth subsequently filed a Chapter 7 bankruptcy petition but failed to include his personal injury claim against Munoz on his bankruptcy schedules. Following...
