BLACKWELDER v. STATE

No. 93-03829.

647 So.2d 991 (1994)

Edwin F. BLACKWELDER, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

December 16, 1994.

Attorney(s) appearing for the Case

John N. Hogenmuller, Asst. Gen. Counsel, Florida Parole Com'n, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee and Dell H. Edwards, Asst. Atty. Gen., Tampa, for appellee.

PER CURIAM.

Edwin Blackwelder appeals the summary denial of his "motion for relinquishment of jurisdiction." We treat this appeal as a petition for writ of certiorari1 and deny relief.

In 1981 Blackwelder was convicted of second degree murder and sentenced to 75 years. The sentencing judge retained jurisdiction over one-third of the sentence for purposes of disapproving parole. See § 947.16(3), Fla. Stat. (1981).
