This is an appeal from an order granting a motion to dismiss for failure to state a cause of action. Appellant, an inmate, alleged in an action brought under 42 U.S.C. § 1983, that appellee, a physician at Charlotte Correctional Institution, in her individual capacity, was guilty of deliberate indifference to his serious medical needs in violation of the eighth amendment to the U.S. Constitution.
