WEAVER, Justice.

Appellant, Steven Raymond Brown, was convicted by a jury of two offenses: possession of marijuana of more than five pounds but less than fifty pounds, and aggravated assault on a peace officer. The jury assessed punishment, enhanced by one prior felony conviction, at forty years' confinement for the possession conviction, and forty-five years' confinement for the assault conviction.
