Defendant, Christopher McCants, was charged by grand jury indictment with the first degree murder of Danielle Anderson, a violation of LSA-R.S. 14:30. Defendant pled not guilty and, after trial by jury, was found guilty as charged. At the sentencing hearing, the jury was unable to agree on a determination of the penalty to be imposed; under LSA-C.Cr.P. art. 905.8, the trial court imposed a sentence of life imprisonment without
