Plaintiffs/appellants are the widow and children of the late Jose M. Solis Rivera. Plaintiffs brought this action pursuant to the Federal Tort Claims Act ("FTCA"), 28 U.S.C. § 2671 et seq., claiming that the United States Department of Veterans' Affairs ("VA") negligently failed to diagnose and treat Solis Rivera's prostate gland cancer.
