Gene Ray Hess appeals his conviction of first degree murder. Gene Ray Hess and James Terryl Buras were indicted by a grand jury for the murder of John Kevin Ryan. Because the murder was alleged to have been committed during an armed robbery, the charge was first degree murder. L.S.A.-R.S. 14:30(A)(1).
