This action arises out of an annexation agreement containing a recapture provision and a settlement agreement entered into between plaintiff, SBL Associates and defendant, the Village of Elk Grove. Plaintiff's complaint asserted claims of breach of contract and specific performance, and sought declaratory relief and restitution for unjust enrichment against defendant....
