The state appeals a judgment dismissing its paternity action against Mark A. entered upon a jury verdict finding that he was not the father of Jodi L.'s son. The state alleges trial court error in refusing to grant a default judgment, denying its motion for a bench trial rather than a jury trial and admitting evidence of Jodi's sexual intercourse with males excluded from paternity by genetic testing.
