PROCEDURAL BACKGROUND AND FACTS

This action arises out of an accident which occurred on November 11, 1990. At approximately 6:45 a.m., plaintiff, Glenn Geiswite, was walking south across Park Avenue in Woolrich, Pennsylvania, on his way to work.
