Defendant appeals as of right from a circuit court order granting plaintiff's motion for summary disposition pursuant to MCR 2.116(C)(10) in an action to determine plaintiff's rights to proceeds from a contract of insurance on the life of Stanley C. Brandt, now deceased. We reverse and remand.
