In this case, the court is called on to determine whether the state has proven beyond a reasonable doubt the defendant's guilt in seventy-six counts of drug law violations involving sale of controlled substances and making false prescriptions. After the state presented its case in chief, the court dismissed thirty-three counts and four additional counts were nolled by the state.
