Plaintiff-appellant Carmen Fragoso de Conway (Fragoso), a citizen of New Jersey, appeals from an order of the district court granting summary judgment in favor of certain defendants, including an insurer, Corporacion Insular de Seguros (CIS), which became insolvent during the pendency of the appeal. We now conclude (1) that there is no compelling reason, based on either Erie R.R. Co. v. Tompkins, 304 U.S. 64
