While the police had Michael Stearns' apartment building surrounded and were waiting for him to exit the building to take him into custody, a police detective telephoned Stearns to encourage him to surrender. During the telephone conversation, Stearns made several statements which implicated him in the armed robbery that the police had sought to question him about. The issue on appeal is whether the trial court erred in granting Stearns' motion to suppress...
