In this appeal, we decide that the jurisdiction of the Territorial Court of the Virgin Islands is determined by reference to the maximum penalty provided for the charged offense. The fact that the sentence may be enhanced by application of the habitual criminal provisions does not deprive that court of the power to try and sentence the defendant...
