This Court is asked to determine whether the trial court properly granted a summary judgment in a suit against an insurer for violations of the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA),1 the Insurance Code,2 and for breach of the duty of good faith and fair dealing.
