FACTUAL AND PROCEDURAL HISTORY

On June 5, 1980, Thomas McDevitt was severely injured when the van he was driving was involved in a single vehicle accident. Several months prior to the accident, McDevitt had purchased a 1965 Chevy van and thereafter contacted the Giantonio Insurance Agency Inc. to obtain insurance coverage on that vehicle.
