Ordered that the judgment is modified, on the facts, and as an exercise of discretion, by deleting the provision thereof awarding counsel fees in the amount of $59,375 and substituting therefor a provision awarding counsel fees in the amount of $35,572.50; as so modified, the judgment is affirmed insofar as appealed from, without costs...
